Text a data mining šedé literatury pro vědecké účely

Abstract

Příspěvek zkoumá možnosti uživatelů jak legálně realizovat text a data mining nad repozitáři šedé literatury (a v nich obsažených dokumentech) pro vědecké účely bez souhlasu provozovatele repozitáře šedé literatury a nositelů práv k jednotlivým dokumentům. Nejprve je analyzován rozsah omezení výlučných práv (autorské právo, zvláštní práva pořizovatele databáze) a následně je prozkoumán význam pojmu „vědecké účely“ v příslušných regulačních nástrojích. V poslední části je představeno debatované omezení exkluzivních práv pro TDM pro vědecké účely.The paper explores the legal possibilities of users to text and data mine repositories of grey literature for scientific research without the consent of the GL repository operator and right holders of the documents contained therein. Firstly the scope of the respective copyright and sui generis database rights exceptions for scientifi c research is analyzed. Secondly the term “scientific research” and its meaning in the regulatory instruments is explored. Lastly the debated mandatory exception for TDM for scientific research is introduced.
